1. SCOPE

1.1 The operator of the online shop accessible at www.dillytech.ch (hereinafter "Online Shop") and your contracting party is:

The following General Terms and Conditions (hereinafter "GTC"), as amended at the time of the order, along with all other provisions referenced therein—particularly the Privacy Policy and the Return Policy (collectively "GTC")—apply exclusively to Dillytech International Trade – Öztürk ("DillyTech") and its customers who make purchases through the DillyTech Online Shop.

The customer (hereinafter "Customer" or "you") within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. We sell our products only to customers who are at least 18 years of age.

1.2 These General Terms and Conditions also apply correspondingly to contracts for the delivery of gift cards (vouchers), unless expressly stated otherwise.

2. CONCLUSION OF THE CONTRACT

2.1 Our product presentation on our website and in the Online Shop constitutes a non-binding invitation for you to purchase products from us. All orders are subject to our acceptance and availability. We can only accept orders with a maximum total value of CHF 1,000 (including VAT but excluding shipping costs). We offer products for sale that are in stock. Please note that in exceptional cases, certain products might not be delivered if we discover issues during quality control after receiving your order. In such cases, we will inform you by email and refund your credit card payment within 2 days after notifying you of the product's unavailability.

You may submit your offer using the online order form integrated into our Online Shop. After placing the selected goods and/or services in your virtual shopping cart and completing the ordering process, you make a legally binding contractual offer for the products and/or services in your shopping cart by clicking the button that concludes the ordering process. The Customer remains bound by this order for 2 days. The contract is conclusively formed if we accept the order within this period in accordance with Section 2.2.

2.2 We may accept the Customer's offer within 2 days. A valid contract only arises if we expressly declare our acceptance of the contract. We declare acceptance of the contract by sending the Customer an email confirming the order ("Order Confirmation"). A second email will follow confirming that the goods have left our warehouse ("Shipping Confirmation") together with the invoice and packing slip.

2.3 In particular, we will not accept orders in the following cases:

  1. We are unable to obtain payment authorization.
  2. The ordered product is not in stock or does not meet our quality control standards and is therefore withdrawn.
  3. The Customer does not comply with these General Terms and Conditions.

2.4 The contract is concluded in the languages available on our website. The data we store serves as proof of the contract and the transaction.

2.5 The Customer can correct any data entered before submitting the binding order using the usual keyboard and mouse functions in the Seller's online order form. In addition, all data entered is displayed once more in a confirmation window prior to submitting a binding order and can also be corrected there using the usual keyboard and mouse functions.

2.6 Order processing and communication generally take place via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct, so that emails sent by the Seller can be received. In particular, if the Customer uses spam filters, it is the Customer's responsibility to ensure that all emails sent by us or by third parties on our behalf for order processing can be delivered.

3. PRICES

3.1 Unless otherwise stated in the product descriptions, the prices quoted are total prices that include statutory VAT. Any additional delivery and shipping costs are indicated separately in the respective product description. At the time of writing this policy, our sales in Switzerland are exempt from VAT collection. If there is a change in this status, this policy will be updated accordingly.

3.2 Shipping costs are charged as follows:

Shipping costs are indicated during the order and payment process. Unless otherwise stated, shipping within Switzerland is free of charge if your order exceeds CHF 50 excluding shipping costs.

3.3 For deliveries to countries outside the European Union, additional costs may arise in individual cases (e.g., bank transfer fees, exchange fees, import duties, or taxes) for which we are not responsible and which the Customer must bear. Such transaction costs may also apply if the delivery does not go to a non-EU country but the Customer makes the payment from a non-EU country.

4. PAYMENT METHODS

4.1 Payment can be made using one of the methods indicated in our Online Shop.

4.2 You confirm that the credit card used belongs to you or that you have been expressly authorized by the credit card holder to use it. All credit card holders are subject to validation checks and authorization by the card issuer. If your card issuer refuses payment, we will not accept your order and are not liable for delays or failure to deliver.

4.3 We take all reasonable measures to keep our website secure. Our website integrates several payment gateways to ensure flexible payment options for our customers.

Credit card transactions on our website are processed via "Shopify Payments," a secure online payment gateway that encrypts your card details in a secure hosted environment. Even if you are a registered DillyTech user, we will not store your credit card details on our systems.

For express payments where customers have valid wallets in PayPal, Google, and Apple, quicker payments are possible.

To ensure that your shopping experience is secure and easy, DillyTech uses Secure Socket Layer (SSL) technology.

5. DELIVERY CONDITIONS AND TRANSFER OF RISK

5.1 Unless otherwise agreed, the goods are delivered to the delivery address provided by the Customer. The delivery address specified in the Online Shop's order processing is decisive for carrying out the transaction.

5.2 Delivery to P.O. boxes is not possible. In addition, the General Terms and Conditions of the transport company found on the transport company's website apply.

5.3 If the assigned transport company returns the goods to us because delivery to the Customer was not possible, you shall bear the costs for the unsuccessful shipment. This does not apply if the impossibility of delivery is due to circumstances beyond your control or if you were temporarily prevented from accepting the delivery, unless we had informed you of the delivery a reasonable time in advance.

5.4 Our obligation is limited to shipping the goods; it is fulfilled upon handover of the shipment to the person commissioned with transport. Upon dispatch, the risk of deterioration and accidental loss of the goods transfers to the Customer. We are not obliged to assume any fault on the part of the transport company.

5.5 The delivery periods stated in our Online Shop and in our order acceptance confirmation (pursuant to Section 2.2) are calculated from the date we receive your payment.

Estimated delivery times (Switzerland / Liechtenstein): Within 2 business days

These estimated delivery times serve only as guidelines and start from the shipping date. While we endeavor to deliver the products within the stated timeframe, we do not accept liability for non-compliance with these deadlines.

Risk passes to the Customer upon delivery of the products.

5.6 Personal pickup is not possible.

6. RETENTION OF TITLE

We reserve title to the delivered goods until full payment of the purchase price owed has been made.

8. WARRANTY AND LIABILITY

1. Legal Warranty Period

In accordance with Swiss law, all products sold by DillyTech are covered by a warranty against defects for a period of two years starting from the date of delivery.

2. Scope of the Warranty

The warranty covers defects in material and workmanship that existed at the time of delivery. It does not cover:

  • Damage caused by misuse, improper handling, or unauthorized modifications.
  • Normal wear and tear or consumable parts.
  • Issues caused by external factors, such as accidents, exposure to liquids, or excessive heat.

3. Customer Rights

During the warranty period, customers have the right to request:

  • Repair of the defective product.
  • Replacement with a new, defect-free product.
  • Refund of the purchase price if repair or replacement is not feasible.

4. Warranty Process

To make a warranty claim, customers must:

  • Notify us of the defect at info@dillytech.ch within a reasonable time after discovering it.
  • Provide proof of purchase (e.g., order confirmation or receipt).
  • Return the defective product to us, ensuring it is safely packaged to prevent further damage during transit. After receiving the product and examination, if applicable, we will refund the full amount.

5. Exclusion of Further Liability

DillyTech is not liable for any indirect or consequential damages arising from defective products, to the extent permitted by Swiss law.

9. COLORS

We have made every effort to display the colors of our products on our website as accurately as possible. However, since computer monitors vary, we cannot guarantee that the color shown on your monitor is completely accurate.

10. YOUR PERSONAL DATA

The personal data you provide to us when using our website and Online Shop is extremely important to us, and we will collect and use it only in accordance with our Privacy Policy. In any case, your credit card information is not captured or stored on our website. To ensure maximum security, we use SSL technology on our website.

11. COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS

All content on the website, including texts, images, sounds, illustrations, and software, is our property and/or that of our content providers. By using our website, you do not obtain any rights to copyrights, design rights, trademarks, or other intellectual property rights (or the intellectual property rights of third parties).

12. SEVERABILITY AND AMENDMENT

Should individual provisions of these Terms and Conditions be invalid or incomplete, or should their fulfillment be impossible, the validity of the remaining provisions shall remain unaffected. The contracting parties undertake to replace any invalid provision with a valid provision that most closely reflects its content, approach, and thus its economic purpose.

13. APPLICABLE LAW

All legal relations between the parties shall be governed by the laws of Switzerland, excluding the provisions governing the international sale of goods. For customers, this choice of law applies only insofar as it does not deprive the customer of the protection granted by mandatory provisions of the law of the location in which the customer has his or her habitual residence.
